Terms of Use

1.1. These Terms of Use (hereinafter - the 'Terms') are a public contract of adhesion within the meaning of Art. 634 of the Civil Code of Ukraine and determine the procedure for using the Medunar platform (hereinafter - the 'Platform') by individuals and legal entities (hereinafter - the 'Users').

1.2. By using the Platform, the User automatically accepts these Terms in full without any reservations. If the User does not agree with any provision of these Terms, he is obliged to immediately stop using the Platform.

1.4. Medunar is an educational platform that provides access to educational materials, courses, webinars, testing and certification in the field of medical education. The Platform is intended for continuous professional development of medical professionals and all persons interested in medical education.

3.1. Registration on the Platform is voluntary and free. To create an Account, the User is obliged to provide accurate and up-to-date information, including name, email and other data necessary for registration (Art. 12 of the Law of Ukraine 'On Personal Data Protection').

3.2. The User bears full responsibility for maintaining the confidentiality of their registration data (login, password) and for all actions performed using their Account.

3.4. Medunar reserves the right to refuse registration or block the User's Account in case of providing false information or violating these Terms (Art. 11 of the Law of Ukraine 'On Electronic Commerce').

4.1. The User undertakes to:

• 4.1.1. Comply with the legislation of Ukraine and these Terms when using the Platform.
• 4.1.2. Provide accurate, up-to-date and complete information about themselves during registration and update it in a timely manner.
• 4.1.3. Use the Platform exclusively for personal educational purposes, not to copy, distribute or reproduce Educational Content without the written consent of Medunar.
• 4.1.4. Respect the intellectual property rights of Medunar and third parties whose materials are posted on the Platform.
• 4.1.5. Immediately notify Medunar of any cases of violation of these Terms by other Users.
• 4.1.6. Independently bear responsibility for the security of their registration data and for all actions performed using them.

6.1. All objects of intellectual property posted on the Platform, including but not limited to: texts, video materials, presentations, tests, design, logos, software code, are the property of Medunar and/or its licensors and are protected by the Law of Ukraine 'On Copyright and Related Rights' (No. 2811-IX).

6.2. The User is granted a non-exclusive, personal, non-transferable license to use the Educational Content exclusively for their own learning within the functionality of the Platform. The license is valid during the period of the User's access to the relevant materials.

7.1. The User bears full responsibility for any content they post on the Platform (comments, reviews, questions, answers, etc.). By posting content, the User guarantees that it does not violate the legislation of Ukraine or the rights of third parties.

7.3. Medunar reserves the right to moderate User Content and delete it without warning in case of violation of these Terms, the legislation of Ukraine or the rights of third parties.

8.1. The User is responsible for all actions performed using their Account, including cases of unauthorized access, except when such access occurred as a result of a breach of Platform security by Medunar.

9.1. The User has the right to stop using the Platform and delete their Account at any time. To do this, you need to contact Medunar's support service at medunar.alp@gmail.com.

9.2. Medunar has the right to terminate these Terms and/or block the User's Account in the following cases:

• 9.2.1. Gross or systematic violation of these Terms by the User.
• 9.2.2. Providing false information during registration.
• 9.2.3. Violation of the legislation of Ukraine or the rights of third parties.
• 9.2.4. Non-payment for paid Platform services (if any).

10.1. All disputes arising between the User and Medunar are subject to mandatory pre-trial claim procedure. The term for consideration of the claim is 10 (ten) working days from the date of its receipt.

10.2. If agreement is not reached, the dispute is referred to court at the location of Medunar (Commercial Court of Kyiv or Solomyansky District Court of Kyiv). The User - an individual has the right to apply to the court at their place of residence in accordance with Art. 24 of the Law of Ukraine 'On Consumer Protection'.

11.1. Medunar reserves the right to unilaterally make changes to these Terms due to changes in the legislation of Ukraine, improvement of the Platform or other circumstances. The new version of the Terms is published on this page and comes into force 10 (ten) calendar days after publication.

11.2. The User is obliged to independently familiarize themselves with the current version of these Terms. Continued use of the Platform after the new version of the Terms comes into force means the User's consent to such changes.
